呼 吁 释 放 牛 腾 宇 的 公 开 信
尊敬的美国国会及行政当局中共委员会：
尊敬的众议院美国与中国共产党战略竞争特设委员会：
2019年5月,继海外网站“支那维基”与“红岸基金会”先后发布习近平姐夫邓家贵与女儿习明泽个人资料后，广东茂名公安拘捕转发链接的“恶俗维基”网站24名成员。之后在中共高层的直接授权下，由中共国安部、公安部和广东省公安厅联合办理，成立专案组，广东各级司法部门为媚上贪功，在无法问责海外网站的情况下，使用移花接木手法炮制引发国际社会广泛关注的恶俗维基冤案。其中“恶俗维基网站”网络维护员牛腾宇被广东省茂名市茂南区人民法院判处14年有期徒刑并处罚金人民币13万元（以寻衅滋事罪判8年罚5万元，以侵犯公民个人信息罪判5年罚4万元，以非法经营罪判2年罚4万元）。年仅19岁的牛腾宇本是一个天才电脑神童，却被关押并遭受惨无人道的酷刑。其被关进非法黑监狱，经历的酷刑包括：长时间吊打、无端地大剂量注射生理盐水、坐老虎凳、抽鞭子、下体，多次因酷刑折磨至生命垂危送医院抢救。 牛腾宇母亲可可女士坚持为牛腾宇申诉目前也被中共无情骚扰迫害，住房被破坏，在住处附近不间断播放噪音，剥夺聘请律师辩护权，剥夺会见及通讯权等等。
根据牛腾宇母亲提供的信息，其于 2023年11月24日与牛腾宇视频会见时，发现牛腾宇精神出现障碍：视频通话中的牛腾宇无法认出自己的母亲，面容呆滞，大声喊叫，胡言乱语。
牛腾宇涉及的“恶俗维基网站案件”完全是政治主导的冤案。恶俗维基是个记录中国互联网中人物和事件的讽刺性网站，相关内容多为注册会员自行上传。牛腾宇并非网站创始人，也非相关争议内容提供方及上传者，其作为网络技术人员对于其他用户上传有关习近平亲属的个人信息，既无主观故意也无共谋或者协助行为。牛腾宇对该项指控不应负任何法律或者道义上的责任。依据《中华人民共和国刑法》，“寻衅滋事行为”主要包括“随意殴打他人，追逐、拦截、辱骂、恐吓他人，强拿硬要或者任意损毁、占用公私财物，在公共场所起哄闹事。”
部分海内外法律界专业人士认为，“恶俗维基网站”用户上传习近平家属个人信息的行为，不符合寻衅滋事罪的相关定义，不属于寻衅滋事罪。该案件即使按照寻衅滋事罪宣判，法定刑罚也在5年以下。
“侵犯公民个人信息罪”的构成是多次提供或者出售等情形，“恶俗维基网站”用户上传习近平家属个人信息的行为，也不符合该罪名。非法经营罪是指未经许可经营法律、行政法规规定的专营、专卖物品或者其他限制买卖的物品等，恶俗维基用户上传习近平家属个人信息的行为，不存在任何的牟利目的和行为，也不符合该罪名。 牛腾宇被指控的相关罪名完全不符合法律规定，判决结果异常峻苛，显然属于基于政治目的及中国高层个人因素的故意陷害。
中国共产党以及他们组建的马列主义政权历来政治挂帅、罔顾法律正义，行政力量直接干预司法运作。被中共官员尤其是高层陷害的普通人，往往会受到极端伤害乃至伤害致死。牛腾宇仅仅是一名网络技术人员，而被陷害入狱，并遭受惨无人道的酷刑。目前牛腾宇在饱受酷刑和深陷绝望情绪中，精神已经崩溃，生命健康受到极大威胁。他的母亲王女士一直在为儿子奔走呼吁，目前她在广东四会监狱探视儿子，迄今仍未见到，牛腾宇情况不明。
我们在此呼吁美国国会、美国政府予以紧急关注，就此与中共当局予以交涉，挽救牛腾宇年轻无辜的生命，挽救陨落的英才少年，同时我们呼吁中共当局遵守国际人权条约以及本国法律，立即无罪释放牛腾宇，给牛腾宇母子全面进行救治，允许牛腾宇到国外治病，确保牛腾宇的人权与公民权不被侵犯，人权无国界。

An open letter calling for the release of Niu Tengyu

In May 2019, following the release of personal information about Xi Jinping’s brother-in-law, Deng Jiagui, and his daughter Xi Mingze by overseas websites “Zhina Wiki” and “Hongan Foundation,” the Guangdong Maoming Public Security Bureau arrested 24 members of the “Vulgar Wiki” website for sharing links. Subsequently, with direct authorization from the top echelons of the Chinese Communist Party (CCP), a joint task force was established by the Ministry of State Security, the Ministry of Public Security, and the Guangdong Provincial Public Security Department. In an attempt to deflect accountability from the overseas websites, a political motivated and internationally scrutinized case was fabricated, leading to the sentencing of Niu Tengyu, a network maintenance worker for the “Vulgar Wiki” website, to 14 years in prison and a fine of RMB 130,000 (8 years for provocation and troublemaking, with a fine of 50,000 yuan; 5 years for infringing on personal information with a fine of 40,000 yuan; 2 years for illegal business operations with a fine of 40,000 yuan).
Niu Tengyu, a prodigious computer whiz at the age of 19, has been subjected to inhumane torture while unjustly imprisoned. His ordeal in an illicit black prison included prolonged beatings, indiscriminate high-dose injections of saline, the use of a torture device known as the “tiger chair,” whipping, and genital burning. Niu Tengyu’s life has been repeatedly endangered, leading to multiple hospitalizations due to the severe physical and psychological toll of the torture. Mrs. Keke, Niu Tengyu’s mother, who persists in advocating for her son, has faced ruthless harassment and persecution by the CCP. Her residence has been vandalized, continuous noise is played near her home, and she has been deprived of the right to hire a defense lawyer, visitation rights, and communication rights.
According to information provided by Niu Tengyu’s mother, during a video call on November 24, 2023, she observed signs of mental impairment in her son. Niu Tengyu, in the video call, failed to recognize his own mother, exhibited a vacant expression, shouted loudly, and spoke incoherently.
The charges against Niu Tengyu in the “Vulgar Wiki” case are purely politically motivated. “Vulgar Wiki” is a satirical website documenting personalities and events in the Chinese internet, with content mostly uploaded by registered members. Niu Tengyu is neither the founder of the website nor involved in providing or uploading controversial content related to Xi Jinping’s relatives. As a network technician, he had no subjective intent, conspiracy, or cooperative behavior in relation to the personal information uploaded by other users. Niu Tengyu should bear no legal or moral responsibility for these charges.
According to the Criminal Law of the People’s Republic of China, “provocation and troublemaking” primarily involves “arbitrarily beating others, chasing, intercepting, insulting, intimidating others, forcibly taking or arbitrarily damaging, occupying public or private property, causing a disturbance in public places.” Some legal professionals, both domestically and internationally, argue that the actions of “Vulgar Wiki” users uploading personal information about Xi Jinping’s family members do not meet the definition of the crime of provocation and troublemaking and, even if charged, the statutory penalty would be less than 5 years.
The offense of “infringing on personal information” involves multiple instances of providing or selling such information. However, the actions of “Vulgar Wiki” users uploading personal information about Xi Jinping’s family members do not align with this charge. The crime of illegal business operations refers to the unlicensed operation of items restricted by laws or administrative regulations. The actions of “Vulgar Wiki” users do not demonstrate any profit motive and do not correspond to this charge. The charges against Niu Tengyu are in complete contradiction to legal provisions, and the severe judgment appears to be a deliberate act of political persecution based on political motives and personal factors within the top echelons of the Chinese leadership.
The Chinese Communist Party, along with its Marxist-Leninist regime, has a history of prioritizing political considerations over legal justice, with direct interference of administrative forces in judicial proceedings. Ordinary individuals who fall victim to persecution by CCP officials, especially those at the higher echelons, often suffer extreme harm, even to the point of fatal consequences. Niu Tengyu, a mere network technician, has been wrongly imprisoned and subjected to inhumane torture. Currently, he is in a state of physical and mental breakdown, with his life and health under significant threat. His mother, Mrs. Wang, has been tirelessly advocating for her son and is currently visiting him at the Sihui Prison in Guangdong, where she has yet to gain access to her son, and Niu Tengyu’s condition remains unknown.
We urgently appeal to the U.S. Congress and the U.S. government to pay close attention to this case, engage in dialogue with the CCP authorities, and save the young and innocent life of Niu Tengyu, a talented youth who is facing a tragic fate. Simultaneously, we call on the CCP authorities to abide by international human rights treaties and their own legal system, immediately release Niu Tengyu without any guilt, provide comprehensive medical treatment for Niu Tengyu and his mother, allow Niu Tengyu to seek medical treatment abroad, and ensure that his human rights and citizenship rights are not violated, as human rights know no borders.
